Google's new world and your privacy: Why you should worry

A significant part of your life revolves around Google. You use Gmail for work as well as personal emails. You use Google+ for virtual bonding and sharing content. You use Picassa to store photos, and YouTube for your fix of video clips. You know Google is tagging advertisements as well tailoring search depending on your web history. But, starting March 1, Google will do something more. Under its new privacy policy, it will combine data from all its services in one place, as part of its 'Google Plus Your World' programme.

This can be useful. But also troublesome. Suppose User X watched a little too much of belly dancing video clips on YouTube. When he and his kids are using his account and are on Picassa, browsing family photos, an advertisement for a service tagged to his YouTube habits may appear. Embarrassing? Would you like more privacy? Google thinks the service will be incredibly empowering.

NO LEGAL IMMUNITY FOR GOVT SERVANT IN CRIMINAL CASES: SC

New Delhi, Mar 6, 2012 (PTI): A public servant facing charges of corruption, cheating and other criminal cases in the discharge of his or her duties does not enjoy any legal immunity as no prior sanction is required for prosecuting such officials.
A bench of justices R M Lodha and H L Gokhale set aside the concurrent findings of the Punjab and Haryana High Court and a sessions court which had quashed the prosecution and summons issued to a Deputy Excise and Taxation Commissioner, Gurgaon
The Supreme Court will provide no legal immunity for government servants in cheating and other criminal cases.

Citing the apex court ruling in the Prakash Singh Badal (2007) case, the bench said, “The offence of cheating under Section 420 or for that matter offences relateable to Sections 467, 468, 471 and 120-B can by no stretch of imagination by their very nature be regarded as having been committed by any public servant while acting or purporting to act in discharge of official duty.”
While Section 420 relates to cheating, sections 467, 468, 471 pertains to forgery and 120-B applies in cases of criminal conspiracy.
In the present case the official was accused by Omkar, a transporter, of collecting Rs two lakh money from him after impounding his three vehicles and refusing to issue any receipt.
Based on Dhankar’s complaint, judicial magistrate, Gurgaon, on June 2, 2001 issued him summons to face trial under Sections 420 (cheating), 406 (criminal breach of trust) and 161 (illegal gratification by a public servant) IPC.
On a criminal revision appeal filed by the official, the additional sessions judge quashed the summons and a single judge of the high court affirmed the order while dismissing Dhankar’s appeal. Aggrieved, he filed the special leave petition in the apex court.

Fingerprint based Attendance at West Bengal

Government employees can no longer sneak a French leave or walk out before 5.30pm. The Mamata Banerjee government is installing fingerprint readers that will record the time an employee logs in and logs out of office.
Attendance has always been a prickly issue with government employees. Many staff walk in late by simply signing in. Those who sneak out before closing time have evolved any number of smart tricks, including leaving their spectacles or bag on their table to feign that they are around and would return any time. Last week, on the day of the bandh, there was a tampering of the attendance register in the agriculture directorate at Writers’ Buildings. Some staff were absent in spite of the threat of break in service but when a headcount was ordered, the page for February28 went missing.
Once the biometric system is introduced, attendance registers will be redundant, officers said. The previous Left Front government had tried to implement it but failed. But the Mamata Banerjee administration is rolling it out with the Swasthya Bhavan (health department HQ) in April. Last week, the health department completed installing four fingerprint terminals in the lounge. The employees won’t have any card to swipe. Each terminal has a ‘reader’ to scan the fingerprint and match it to a databank.
Earlier attempts to improve attendance at government offices had a lukewarm response, but this time, officials hope to achieve success by introducing the fingerprint system in all government offices.
Generally, secretariat staff start leaving around 3.30pm and after 4.30pm there is a great rush to leave when the official check-out time is still an hour away.
Health secretary Sanjay Mitra had earlier tried to use SMS-based technology to get information about functioning of out patient departments (OPD) in government hospitals. But it was found that many hospital superintendents were sending SMSes to show that the OPDs were functioning from 9am without verifying whether there were any doctors present. In reality, many OPDs were not operating. Health officials want to install the biometric attendance system at all hospitals and health centres.
A recent survey by the health department found that staff would often indulge in ‘mini-shifts’ and instead of work far less than the mandatory 48 hours a week. Many teaching doctors were also found absent from medical college hospitals, say sources.
“The fingerprint system will help keep a tab on the doctors and staff. There will be special system for those who work in shifts,” said an official. Sources say staff of colleges and universities will also have to clock in with a biometric system.

OBSERVE INTERNATIONAL WOMEN’S DAY IN A BEFITTING MANNER

It is 8th March –; the International Women’s Day that is being observed all over the world. The women who constitute half of the human population continue to be the victims of liberalization policies on the one hand and male chauvinism and feudalistic outlook in the society at large on the other. Even the so called economically liberated women are not fully liberated socially. The much talked about legislations on empowerment of women are yet to take off in our country ,despite  campaigns unleashed by the enlightened women organisations in frequent intervals.

The women employees in different sectors, where their general problems are being tackled through the organised  trade union movement, face several women specific problems on which the trade union leadership are not sensitised so far. The most serious problem that the women employees face and suffer silently is the sexual harassment by fellow workers in general and the officers in particular. Trade unions must take up this issue seriously and ensure that women committees as envisaged by the DOPT.

The women employees who constitute more than 20 to 40 percent depending upon the places of work, are yet to be unionised fully. Except for payment of union subscriptions and occasionally attending union conferences to elect the leaders of the associations and unions,  seldom  they are encouraged to take part in other day to day work of the trade unions.

There are States like West Bengal and Kerala where women organisations are constituted by the class conscious trade union movement. Such initiatives are needed elsewhere also. Even in All India Federations and Associations such Mahila Committees are only in the formative stages.

Taking into all these aspects, the Confederation called upon the Affiliates to organise women Committees.  The Confederation  convened its all India Women meet at Kolkata. The Kolkata convention elected an all India Women Committee. The said Committee has   been mandated to bring about such committees all over the country..

The International Women’s Day is coming up in this particular backdrop. The All India Women Sub- Committee headed by Comrades  Gita Ghoshal Chair Person and C.P.Shobana Convenor has already called upon the entirety of the Confederation Affiliates to organise special women conventions, seminars and other types of organisational activities with specific reference to mobilisation of women employees working in CG Departments.

Confederation Headquarters calls upon the State Committees and the Affiliates of Confederation to observe the International Women’s Day on March 8th in a befitting manner by implementing the call of the Women Committee of Confederation.

With International Women’s Day Greetings
K.K.N.Kutty
Secretary General
