A press release has been issued by the Central Government Welfare Co-Ordination Committee in Kerala regarding the change of holiday on account of Bakrid. The holiday on account of Bakrid for the Central Government Offices in Kerala will be on October 26 (Friday) instead of Saturday as in the case of State Government Offices.
Holiday for Idul Zuha (Bakrid) changed from 27th October to 26th October, 2012 consequent on change in Kerala State Government Holiday.

Grant of leave without allowance for Kerala State Government Employees who are under Probation:




Government of Kerala has issued necessary orders (G.O.(P) No. 471/2012/Fin dated 23.08.2012) for grant of leave without allowance under Appendix XII A and XII C Part I Kerala Service Rules, before completion of probation after cancelling earlier government order G.O.(P) No.161/2008Fin. dated 09.04.2008 which was not allowing this facility.

Government of Kerala has now reviewed the position and ordered that the earlier government order in this regard stand cancelled and grant of leave without allowance for the employees who are on probation.

The conditions specified in this order dated 23.08.2012 are

(i) Non- Government employees in regular service, who have not completed probation in the entry cadre shall be granted leave without allowance under Appendix XII A and Appendix XII C Part I Kerala Service subject to the condition that they will have to start their probation afresh and complete the probation on return from leave without allowance. In other words, the officerswill forfeit the service benefits that have accrued to them prior to their proceeding on leave without allowance and they will be deemed as new entrants to Government Service on return from leave without Allowance. What is protected is only the right to rejoin service in the same cadre as if they are new entrants.
(ii) If on further verification by the Kerala Public Service Commission/Police verification, it is found that the officer is ineligible for appointment, the appointment will be treated as null and void and leave without Allowance will be treated as cancelled from the date of sanction of leave.
(iii) The vacancy arising due to such grant of leave without Allowance shall be filled up, and theofficers who enter on Leave without Allowance shall not be permitted to rejoin duty before the expiry of sanctioned term of Leave without Allowance.

Kerala to introduce Contributory Pension scheme for Government Staff
The employees would be required to contribute 10 per cent of their pay and dearness allowance to the pension fund. The government would also make a contribution to the fund.
The government has issued orders approving, in principle, the proposed contributory pension plan for government employees. The plan is proposed to apply to new recruits joining service from next year.

Pensions would be available to employees who contribute to the fund for a specified number of years. Payment of full pension by government would be discontinued.
Opposition Leader V. S. Achuthanandan, CPI State Secretary Pannian Raveendran and the Joint Council of State Service Organisations have decried the decision to introduce contributory pension scheme.
The Opposition Leader said in a statement here on Thursday that the order to undermine statutory pension and impose ban on appointments was a challenge to the people and demanded its withdrawal.
He recalled that the Chief Minister Oommen Chandy had promised in the Assembly that the contribution pension scheme would be implemented only after consultations with all concerned. The government was showing disrespect to the Assembly and democratic systems by dismantling the long-standing provision for statutory pensions through a government order.
Mr. Pannian Raveeendran said that order betrayed youth seeking employment in government service. The government was undermining statutory pensions following the economic policies of the Central government.
The Joint Council announced that t it would organise protests at district and taluk centres and office complex across the State on Friday demanding withdrawal of the order.

Relaxation of condition relating to enhancement of age of superannuation of teachers in state institutions consequent of the implementation of the revised pay scales on the basis of 6lh Pay Commission recommendations


The Cabinet today approved the proposal to relax the condition of enhancement of age of superannuation of teachers to 65 in state institutions for the implementation of the revised pay scales on the basis of 6lh Pay Commission recommendations and become eligible for receiving Central share of 80% of the arrears payment.

It also decided that reimbursement of 80% of the Central share of the arrears be paid in 2-3 installments to those States who have already made the payment and submitted their proposals for reimbursements to the Central Government.

The decision of Cabinet is expected to provide relief to teachers in State institutions with the payment of arrears. It will also benefit State Governments, who will be able to make the arrear payment in installments and also claim reimbursements simultaneously.

Background:

Following the revision of pay scales of Central Government employees on the recommendation of the 6ifl Pay Commission, the pay scales of teachers and other equivalent cadres was revised and age of superannuation was enhanced to 65 in December 2008. The scheme of revised pay scales was essentially for teachers in Central Educational Institutions. However, provisions of the Scheme could be made applicable by State Governments, to Universities and Colleges coming under the purview of the State Governments, provided the State Governments adopt and implement the scheme as a composite scheme, including the enhanced age of superannuation.

The Central Government decided to provide financial assistance to the extent of 80% as reimbursement to those State Governments, which may opt for these revised pay scales for the period 1.1 2006 to 31.3.2010 The remaining 20% was to be met by the State Government from its own resources. The Central assistance was subject to the condition relating to the enhancement of the age of superannuation of university and college teachers to 65 years.
Many State Governments had requested the Central Government to waive the condition relating to enhancement of age of superannuation of teachers to 65 years as they were finding it difficult to accept the condition relating to enhancement of age of superannuation and the condition that the State Governments should first disburse the arrears and then seek reimbursement from Central Government to the extent of 80% of these arrears.

Enhancement of age of Retirement in Kerala

Enhancement of age of retirement of Government Employees and Teachers – Closure of General Provident Fund Accounts.
The Finance Department (Provident Fund) of Kerala Government has issued detailed instructions regarding the above matter on 30th May 2012 on its website.
The Kerala Government have withdrawn the unification of the date of retirement and enhanced the age of compulsory retirement of Government Employees, Teachers and Staff of Aided Educational Institutions to 56 years and made it statutory also.

The Accountant General in the meantime, has processed several General Provident Fund accounts of Government Employees and Teachers, who would have to retire from service on 31.03.2012 as per existing rule
and authorisations issued on settlement of the accounts in many and many more closure applications have been in advanced stage of processing and sought to issue necessary orders treating the already closed General Provident accounts and those submitted for closure,vide Rule 39 of General Provident Fund (Kerala) Rules as closed disallowing any further remittance despite Rule 7(e) of General Fund (Kerala) Rules. He has further requested that those subscribers who have not submitted closure applications so far may be allowed to continue till they attain superannuation and so will be allowed with in the confines of Rule 7 (a) and (d).
Government have examined the matter in detail and are pleased to issue the following orders with immediate effect:
The already closed General Provident Fund accounts or submitted closure applications as per Rule 39 of General Provident Fund (Kerala) Rules of those Government Employees and Teachers but continue in service consequent on enhancement of age of retirement as per Government Order cited 1st shall be treated as closed and no further subscriptions shall he entertained ¡n relaxation of Rule 7 (e).
Those subscribers including teachers who enjoy the benefit of extended service, but have not submitted applications for closing the General Provident Fund accounts as per Rule 39 General Provident Fund (Kerala) Rules so far would continue to subscribe to the Fund and their accounts will be settled invoking Rule 7 (a), (d) on attaining superannuation and as provided under Rule 39 General Provident Fund (Kerala) Rules.
The Rule 7 (e) stands modified to this extent with the view to accommodate the situation arose as sequel to the lifting of unification of retirement age.
