Pensioners Portal Orders : Instructions regarding date of birth/age of family pensioners.

Sub: Instructions regarding date of birth/age of family pensioners.
This Department has issued instructions vide OM No.38/37/08-P&PW(A), dated 21.5.2009, 11.8.2009, 25.6.2010 & 28.9.2010, OM No.1/19/11-P&PW(E), dated 3.8.2011 and OM No. 1/23/2012-P&PW(E), dated 13.09.2012 for consideration of date of birth/age for grant of additional pension/family pension to old pensioners/family pensioners. Certain documents i.e. PAN Card. Matriculation certificate, Passport, CGHS Card, Driving Licence, Voter’s ID Card and Aadhaar Number issued by UIDAI have been allowed to be accepted in this regard.

2. For revision of an old PPO, date of birth of family pensioner is a mandatory field in the software. Some queries have been received in this Department regarding clarification whether these instructions are applicable for accepting date of birth/age of the spouse at the time of revision of PPOs.
3. It is hereby clarified that the above instructions are applicable at the time of issue/revision of a PPO for a family pensioner irrespcetive of the age of the family pensioners at that time. It is further clarified that in case the exact date of birth is not available in the PPO/office records, the age of the family pensioner as on 1st January may be taken same as what she/he had completed in the previous year. For example. if a family pensioner completes the age of 54 years in 2012, her/his age as on January, 2013 may be taken as 54 years and PPO may be revised accordingly.

Change in Date of Birth/Age of Family Pensioners

OFFICE MEMORANDUM

In accordance with the instructions issued vide this Department's OM No.38/37/08-P&PW(A) dated 21.5.2009, 11.8.2009,25.6.2010 & 28.9.2010 and OM No.1/19/11-P&PW(E) dated 3.8.2011, additional pension/family pension to old pensioners/family pensioners is allowed on the basis of the date of birth/age recorded in the Pension Payment Order (PPO) or other office records. Only in case the details regarding date of birth/age are not available in the PPO/office records, additional pension/family pension to old pensioners/family pensioners has been allowed on the basis of certain documents i.e. PAN Card, Matriculation certificate. Passport, CGHS Card, Driving Licence, Voter's ID Card and Aadhaar Number issued by VIDAL.


2.             During his service and at the time of retirement, a Government servant is required to give details of his family, including date of birth of its members, in Form 3. Date of birth/age of the members of family mentioned by the Government servant in Form 3 was not mandatory to be verified by the Head of Office. It is felt that in some case, the date of birth/age of a family pensioner, as recorded in the PPO/office records might be incorrect.

3.             Some representations have been received in this Department regarding the hardship being caused to old family pensioners in getting the additional pension on account of incorrect recording of the date of birth/age in the PPO. They have been requesting for allowing the change of date of birth in ~he PPO on the basis of the documents prescribed in the various OMs mentioned in Para I above.

4.             The matter has been considered in this Department in consultation with the Ministry of Finance, Department of Expenditure and the following decisions have· been made:

i.               Since the date of birth of the Government servant is recorded in the PPO on the basis of the service records and the date of superannuation etc. also is determined on the basis of this date of birth, there is no question of allowing change in the date of birth of the retired/deceased pensioner in the PPO.

ii.              The request for change of date of birth/age of the family pensioner (parents and spouse) in the PPO may be submitted by a pensioner/family pensioner to the Head of the Department of the organisation where the Government servant had last served along with at least one of the documents mentioned in Para 1 above and a declaration on a non-judicial stamp paper regarding the correct date of birth of the family pensioner. The Head of the Department may allow the change in the date of birth of the family pensioner if he is satisfied that the conditions indicated in this Department's OM No.38/37/08-P&PW (A) dated 21.5.2009 have been fulfilled and that a bona-fide mistake has been made in recording the date of birth in the PPO.

iii.             No other document will be accepted for allowing the change in date of birth/age of the family pensioner in the PPO.

iv.             In order to avoid any possibility of recording an incorrect date of birth in the PPO, in future, the Government servant may be required to submit one of the documents indicated in Para 1 above as proof of date of birth of spouse or parents along with the details of family in Form 3. In the case of children certificate of birth from the Municipal authorities or from the local panchayat or from the head of a recognised school if the child is studying in such a school or from a Board of Education may be accepted.

5.             As regards pensioners/family pensioners belonging to the Indian Audit and Accounts Departments, these Orders issue after consultation with the Comptroller and Auditor General of India.

6.             This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their J.D. No 428/E.V/2012, dated 27/8/2012.

CGEGIS Management changed to Principal AO, Ministry of Finance



The Controller of General Accounts, Department of Expenditure has informed that the work assigned to his office relating to management of CGEGIS-1980 as prescribed in the CGEGIS Accounting Procedure as per O.M. dated 22.9.1981 has been transferred to Pr.AO, Ministry of Finance.
Consequently, certain amendments are made to the Accounting Procedure. All future requirement for the management of information relating to this scheme can be provided by Ministries/Departments to the O/O Pr. AO, Ministry of Finance.

Attention is invited to this Office 0.M.No.S.11013/2/81/TA/2907 dated 22nd September, 1981. and followed by amendments issued vide 0.Ms. dated 1.3.82, 22.9.82, 27.9.84 and 26.12.85 on the subject cited above.
2. The work assigned to this Office relating to management of CGEGIS-1980 as prescribed in the CGEGIS Accounting Procedure circulated in our O.M. dated 22.9.1981 has been transferred to Pr.A0, Ministry of Finance. Consequently, the following amendments are made to the Accounting Procedure therein so that all future requirement for the management of information relating to this scheme can be provided by the line Ministries/Departments to the O/O Pr.AO, Ministry of Finance:-

Subject: Rotational Transfer of Assistant with more than 16 years of service in the same Ministry / Department reg.

The undersigned is directed to refer to this Department’s OM of even number dated 11th April 2012 whereby Cadre Units were requested to furnish information/preference of posting of Assistants who have completed more than 16 years of service in any capacity in a particular Ministry/Department (excluding those who are due for superannuation within two years as on 01.01.2012).

2. It is noticed that a number of cadre units have not furnished the requisite information so far. The defaulting Cadre Units addressed below are therefore, requested to furnish information/preference of posting of Assistants who have completed more than 16 years of service in any capacity in a particular Ministry/Department (excluding those who are due for superannuation within two years as on 01.01.2012) to this Division immediately.

3. The Cadre Units who have earlier furnished only the list of Assistants covered under RTP are requested to obtain the preference for posting in the proforma (copy enclosed) and furnish the same to this Department immediately.

GPF Interest Rate raised again

Govt. has hiked GPF interest rate again for the F.Y. 2012-13. With effect from 1st April 2012, the rate will be 8.8%. It is applicable for General Provident Fund and 10 other similar provident funds managed by Govt. of India.
The interest rate on such funds was 8.6 per cent during December 2011-March 2012 period, while it was 8 per cent for April-November 2011. This move will benefit millions of Govt. employee.

Internet Facility Through Data Card

Subject: Internet facility through data card-reg.
References are being received from various Ministries/Departments seeking clarification/relaxation for internet facility through Data Card. The matter has been reviewed and it has been decided to allow use of data card for internet purposes subject to the following conditions:

(i) No Data-Card (Hardware etc) would be provided by the office and only re imbursement for data use, through data card, will be allowed on submission of bill.
(ii) The User has the liberty to choose any operator/plan beneficial to them.
(iii) Re-imbursement would be allowed for one data card connection only.
(iv) There would be no separate ceiling for the internet through data card and the reimbursement will be allowed to the entitled officer according to the ceiling/guidelines/clarification laid down vide this Department’s OMs No. 7(14)/C&V/2006 dated November l4th, 2006, dated April 14th, 2007 and dated July 9th, 2007. As such, the maximum monthly reimbursable amount, towards charges on residential telephone/mobile phone/broadband/data card use (for internet purposes), to a category of a officer will be as under:

Central Civil Services (Leave) (Third Amendment) Rules, 2012

NOTIFICATION
New Delhi, the 4th April, 2012.
G.S.R…..- In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Auditor and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely:-

1. (1) These rules may be called the Central Civil Services (Leave) (Third Amendment) Rules, 2012.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Civil Services (Leave) Rules, 1972, (hereinafter referred to as the said rules), in rules 43-AA, the existing "Note" shall be numbered as "Note I" and after Note I as so renumbered, the following note shall be inserted, namely :-
Note 2:- "Child" for the purpose of this rule will include a child taken as ward by the Government servant, under the Guardians and Wards Act, 1890 or the personal law applicable to that Government servant, provided such a ward lives with the Government servant and is treated as a member of the family and provided such Government servant has, through a special will, conferred upon that ward the same status as that of a natural born child".
3. In the said rules, in rule 43-B, the following note shall be inserted, namely:
‘Note :- “Child” for the purpose of this rule will include a child taken as ward by the Government servant, under the Guardians and Wards Act, 1890 or the personal Law applicable to that Government servant, provided such a ward lives with the Government servant and is treated as a member of the family and provided such Government servant has, through a special will, conferred upon that ward the same status as that of a natural born child".

Definition of “Permanent Absorption” in PSU etc

The Department of Personnel and Training (DOPT) has decided to  introduce a new clause regarding “Permanent absorption” in the CCS (Leave) Rules vide Notification dated 28.03.2012.  As per the new amendment, the term ‘permanent absorption’ used in rule 39-D of CCS Leave Rules, shall mean the appointment of a Government servant in a Public Sector Undertaking or an Autonomous Body, for which he had applied through proper channel and resigns from the Government service to take up that appointment.

Notification

GSR.......(E) .... In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to the persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely:-


I. (i) These rules may be called the Central Civil Services (Leave) (Amendment) Rules, 2012.

(2) They shall come into force on the date of theìr publication in the Official Gazette.

2. In the Central Civil Services (Leave) Rules, 1972, for rule 12, the following rule shall be substituted, namely:-

“12.(I) No Government Servant shall be granted leave of any kind for a continuous period exceeding five years.

(2) Unless the President, in view of the exceptional circumstances of the case, otherwise determines,  a Government servant who remains absent from duty for a continuous period exceeding five years other than on foreign service, with or without leave, shall be deemed to have resigned from the Government service :

Provided that a reasonable opportunity to explain the reasons for such absence shall be givne to that Government servant before provisions of sub-rule (2) are invoked”.

Subject: Reservation for Other Backward Classes in Civil Posts and Services under the Govt. of India — Sub-quota for Minority Communities.

The undersigned is directed to invite attention to this Department's O.M. No.36012/22/93-Estt.(SCT) dated 8th September, 1993 regarding reservation for Other Backward Classes in civil posts and services under the Government of India.

2. The Government of India had set up the National Commission for Religious and Linguistic Minorities to suggest criteria for the identification of the socially and economically backward sections amongst Religious and Linguistic Minorities and to recommend measures for their welfare, including reservation in Government employment. The Commission submitted its report to the Government on 10th May. 2007, wherein it had, inter-alia, recommended creation of a sub-quota for minorities from within the reservation of 27% available to OBCs, in Government employment.

3. The Government have carefully considered the above recommendation and it has been decided to carve out a sub-quota of 4.5% for minorities, as

defined under Section 2 (c) of the National Commission for Minorities Act. 1992, from within the 27% reservation for OBCs as notified by the aforesaid O.M. The castes / communities of the said minorities which are included in the Central list of OBCs, notified state-wise from time to time by the Ministry of Social Justice and Empowerment, shall be covered by the said sub-quota.

4. Similar instructions in respect of public sector undertakings and financial institutions including public sector banks will be issued by the Department of Public Enterprises and by the Ministry of Finance respectively.

5. These orders will have effect from 1st January, 2012 and the O.M. No. 36012/22 93-Estt. (SCT), dated 8th September, 1993 stands modified to the above extent.

Reservation in promotion Treatment of SC/ST candidates promoted on their own merit

Subject: Reservation in promotion Treatment of SC/ST candidates promoted on their own merit.

The undersigned is directed to refer to this Departments O.M.No.36028/17/2001-Estt. (Res.) dated 11th July, 2002 which clarified that SC/ST candidates appointed by promotion on their own merit and not owing to reservation or relaxation of qualifications will be adjusted against un-reserved points of the reservation roster and not against reserved points. It was subsequently clarified by this Department’s O.M. No.36028/17/2001-Estt. (Res.) dated 31.1 .2005 that the above referred O.M. took effect from 11.07.2002 and that concept of own merit did not apply to the promotions made by non-selection method.

2. Central Administration Tribunal, Madras Bench in O.A. No.900/2005 [S. KaÌugasalamoorthy v/s. Union of India & Others] has set aside the O.M. No.36028/17/2001-Estt. (Res.) dated 31.1.2005 and held that when a person is selected on the basis of his own seniority, the scope of considering and counting him against quota reserved for SCs does not arise. The High Court of judicature at Madras in the matter of UO1 v/s.S. Kalugasalamoorthy [WP No.15926/2007) has upheld the decision of the Central Administrative Tribunal.
3. The matter has been examined in the light of the above referred judgments and it has been decided to with draw O.M. No. 36028/17/2001-Estt. (Res.) dated 31.1.2005 referred to above. It s clarified that SC/ST candidates appointed by promotion on their own merit and seniority and not owing to reservation or relaxation of qualifications will be adjusted against unreserved points of reservation roster, irrespective of the fact whether the promotion is made by selection method or non-selection method. These orders will take effect from 2.7.1997. the date on which post based reservation was introduced.
4. These instructions may he brought to the notice of all concerned.
