      The orders regarding the issue of transfer and posting of husband and wife at a same station, when both are Government servants and employees of Public Sector undertakings. Department of Personnel and Training published various orders and instructions through their office memorandums to Ministries / Departments of Central Government as amended from time to time. We have collected some important orders and given with short summary for your information as follows…


Transfer and Posting

Dopt Order – P.Date : 30th September, 2009
Subject : Posting of husband and wife at the same station
Clarification : On the basis of the 6th CPC Report, Govt. servants have already been allowed the facility of Child Care Leave which is admissible till the children attain 18 years of age. On similar lines, provisions of a.M. dated 12.6.97 have been amended. 1.Where one spouse belongs to the All India Service or two of the All India Services, namely IAS, IPS and Indian Forest Service(Group ‘A”): 2.Where one spouse belongs to one of the All India Services and the other spouse belongs to one of the Central Services: 3. Where the spouses belong to the same Central Service: 4.Where the spouse belongs to one Central Service and the other spouse belongs to another Central Service:- 5.Where one spouse belongs to an All India Service and the other spouse belongs to a Public Sector Undertaking: 6.Where one spouse belongs to a Central Service and the other spouse belongs to a PSU: 7.Where one spouse is employed under the Central Govt. and the other spouse is employed under the state Govt.: 8.The husband & wife, if working in the same Department…

Posting of Physically handicapped candidates

Dopt Order – P.Date : 13th March, 2002
Subject : Posting of Physically handicapped candidates.
Clarification : Physically handicapped employees for transfer to or near their native places may also given preference, covers physically handicapped employees in Groups A,B,C and D.

Posting of husband and wife at the same station – Central Staffing Scheme
Dopt Order O.M. No.: No. 28034/2/97-Estt.(A)
Dopt Order – P.Date : 12th June, 1997
Subject : Posting of husband and wife at the same station
Clarification : It is reiterated that all Ministries/Departments should strictly adhere to the guidelines laid down in OM No.28034/7/86-Estt.(A) dated 3.4.86 while deciding on the requests for posting of husband and wife at the same station and should ensure that such posting is invariably done, especially till their children are 10 years of age, if posts at the appropriate level exist in the organisation at the same station and if no administrative problems are expected to result as a consequence. These instructions would be applicable only to posts within the same department and would not appy on appointment under the Central Staffing Scheme.

Posting of Government employees who have mentally retarded children.

Dopt Order – P.Date : 15th February, 1991
Subject : Posting of Government employees who have mentally retarded children.
Clarification : The facilities for medical help and education of mentally retarded children may not be available at all stations, a choice in the place of posting is likely to be of some help to the parent in taking care of such a child. while administratively it may not be possible in all cases to ensure posting of such an employee at a place of his/her choice, Ministries/Departments are requested to take a sympathetic view on the merits of each and accommodate such requests for posting to the extend possible.

Posting of Physically handicapped candidates

Dopt Order – P.Date : 10th May, 1990
Subject : Posting of Physically handicapped candidates.
Clarification : Physically handicapped candidates appointed under the Government should preferably be posted in their native places or at least in their native district and it may not be possible or desirable to lay down that physically handicapped employees belonging to Group-A or Group-B who have all India transfer liability should be posted near their native places.

Posting of husband and wife at the same station – Women’s Welfare
Dopt Order O.M. No.: No.28032/7/86-Estt.(A)
Dopt Order – P.Date : 3rd April, 1986
Subject : Posting of husband and wife at the same station.
Clarification : In Feb., 1976 the then Department of Social Welfare had issued a circular D.O.letter to all Ministries and Departments requesting them to give serious consideration to the question of posting husband and wife at the same station. However, representations continue to be received by the Department of Women’s Welfare in the Ministry of Human Resources Development from women seeking the intervention of that Department for a posting at the place where their husbands are posted. After that Government decided to lay down a broad statement of policy at least with regard to these employees who are under the purview of the Government/Public Sector Undertakings. The cadre controlling authority should consider such requests with utmost sympathy…

Posting of husband and wife at the same station – Railway order
Railway Order O.M. No.: No.E(NG)-2009/tr/29
Railway Order – P.Date : 2nd February, 2010
Subject : Posting of husband and wife at the same station.
Clarification : The guidelines, as framed by DOP&T in view of the 6th CPC, have been examined in this Ministry and it has been decided to adopt these with certain modifications. Accordingly provisions of guidelines issued under Board’s letter dated 5.11.97 ibid have been modified as under :-
1. Where both the spouses are railway employees and belong to the same seniority units:
2.Where both the spouses are railway servants but belong to different seniority units:
3.Where one of the spouses is a railway servant and the other belongs to All India Service or another Central Service:
4.Where one of the spouses is a railway servant and the other belongs to a state service;
5.Where one of the spouses is a railway servant (all India service) and the other is working -in a central/state/Public Sector Undertaking/Autonomous Body/Private Sector:
