Amendment in Anti-Corruption Act, 1988

The property of corrupt public servant is confiscated under the provisions of Criminal Law (Amendment) Ordinance, 1944 and Prevention of Money Laundering Act, 2002. However, to make the Prevention of Corruption Act, 1988 self contained and comprehensive the Government is considering incorporating the provisions for confiscation/forfeiture of property of corrupt public servants in the Prevention of Corruption Act, 1988.

On 8th June, 2011, the media had reported that the Hon’ble Supreme Court has sought amendment to the Prevention of Corruption Act, 1988. These observations were reportedly made by the Supreme Court while dismissing an appeal filed by an Assistant Commissioner, Central Excise, against his conviction. However, the formal order passed by the Hon’ble Supreme Court on 8.6.2011 in the case, i.e. Criminal Appeal No. 945 of 2006 (Sat Paul vs. State of West Bengal & Anr.) does not contain any such observations.

A Committee headed by the Chairman, CBDT has been constituted to examine ways to strengthen laws to curb generation of black money in India, its illegal transfer abroad and its recovery. The Committee shall examine the existing legal and administrative framework to deal with the menace of generation of black money through illegal means including inter-alia (i) declaring wealth generated illegally as national asset; (ii) enacting/amending laws to confiscate and recover such assets; and (iii) providing for exemplary punishment against its perpetrators. The Committee is required to consult all stakeholders and submit its report within a period of six months.

As per information provided by the CBI, it has not unearthed any case wherein benami properties of more than Rs.100 Crore have been unearthed against any officer in any case.

This information was given by Minister of State in the Ministry of Personnel, Public Grievances and Pensions and the Prime Minister’s Office, Shri V. Naraynasamy in written reply to a question in the Lok Sabha today.

Abolition of LDC (Direct Rectt) vacancies

The Department of Personnel and Training (DOPT) New Delhi, has issued an office memorandum today regarding the furnishing of vacancies in the grade of LDC for the Select List Year 2011. The Ministry has directed that as per the decision of the Cabinet, 85% of the posts in the grade of LDC, meant for Direct Recruitment, will have to be abolished every year till the strength reaches 15% of the sanctioned strength of the cadre unit as on 03/10/2003. Accordingly, the remainingvacancies has to be filled up with necessary reservation for SC/ST candidates.

Guidelines to Streamline Pension Payment Issued; Banks Advised to Formulate Pension Friendly Measures

Guidelines regarding dealing with pension related matters have been issued byReserve Bank of India (RBI) vide their circular dated 1.10.2008. These guidelines, inter-alia, stipulate that to streamline pension payment arranged in banks, it would be necessary to establish and operationalise the Central Pension Processing Centers (CPPCs) at an early date. The arrangement of disbursement of pension through the CPPCs would entail following advantages:

A centralized pension cell in a bank would be in a position to; (a) focus exclusively on pension matters; (b) acquire expertise in payment and calculation matters; (c) interact as a single window with the Government Departments; and (d) ensure accuracy and speedy payments every month and thus avoid innumerable complaints from the pensioner.

Further banks have also been advised to formulate following pensioner friendlymeasures:-

(i) Consequent on establishment of the CPPCs, pension payment branch would not have any pension related papers and therefore would not be able to settle pensioners’ complaint directly. Banks should evolve a system so that the pensioners have a regular forum for interaction and settlement of grievances;

(ii) At locations outside the CPPC there should be designated nodal Officers for pension related complaints who should be easily accessible to the pensioners and who should hold regular meetings at different locations in their jurisdiction on the lines of Pension Adalat:

(iii) Each bank should establish a toll-fee dedicated pension-line manned by trained persons with access to the database to answer queries, note-down and redress complaints, etc;

(iv) Bank’s internal inspections of its branches should include specific points such as, delays in the start of pension, payments of Dearness Relief, correctness of pension/ family pension etc;

(v) Nodal Officer/ Inspection Officers should randomly contact the pensioners who visit the branch during inspection and check on the quality of service provided or any problem faced by the pensioners;

(vi) Regular training sessions for bank personal dealing with pension maters may be organized in consultation with the concerned Government Department.

Further, the Government advises all Public Sector Banks to attend to the issues concerning pensioners on priority. As and when any grievance of a pensioner is received, the matter is taken up with the concerned bank for expeditious and effective redressal of the same.

നമ്മുടെ കൊച്ചു കേരളത്തില്‍ തന്നെ സത്യം മുറുകെ പിടിച്ച ഒരുവന് ഇന്നു ജീവിക്കാന്‍ അല്പം എന്നല്ല വലിയ ബുദ്ധിമുട്ടാണ് , അപ്പോള്‍ സ്വാഭാവികം ആയും ആ മനുഷ്യനും ധര്‍മത്തെ കൈവിടുന്നു .ഇവിടെ നിയമ പീഠവും , ഭരണ സംവിധാനവും എല്ലാം അഴിമതിയില്‍ മുങ്ങി കുളിച്ചു നില്‍ക്കുന്നു ഇന്നു ഭരിക്കുന്നവര്‍ തന്നെ പറയുന്നു . ജനങ്ങള്‍ എത്ര കണ്ടു മടുത്തു എന്നത് അഴിമത വിരുദ്ധ പ്രവര്‍ത്തനങ്ങള്‍ക്ക് അന്നാ ഹസാരെയ്ക്ക് ലഭിക്കുന്ന പിന്തുണ കൊണ്ട് മനസ്സിലാക്കാം. നൂറു കൊല്ലങ്ങള്‍ക്ക് മുന്‍പ് നമ്മുടെ ജനതയുടെ ആവശ്യം സ്വാതന്ത്ര്യവും, സാമൂഹിക നീതിയും ആയിരുന്നു എങ്കില്‍ സത്യവും, നീതിബോധവും ഉള്ള സര്‍ക്കാര്‍ ആണ് ജനങ്ങളുടെ ഏറ്റവും വലിയ ആവശ്യം .
