OFFICE MEMORANDUM

Subject: Outsourcing collection of Speed Post and Other Premium Service - Clarification regarding.


1. A reference has been received in Business Devolepment & Marketing Directorate from PMG, Gorakhpur Region, Gorakhpur, related tp the practice of claiming commission on Speed Post articles collected from authorised license holders of franking machines by the Speed Post Outsourcing Agents under "Outsourcing Collection of Speed Post and Other Premium Services Scheme". A clarification is sought for whether such commission is admissible or not.

2. The issue has been examined in consultation with PO Division of the Directorate. The instructions on the subject applicable in this regard are as under: -

(a) The "Outsourcing Collection of Speed Post and Other Premium Services Scheme" was notified vide BD Directorate communication No. 2/ 17/ 96/ BD dated November 23, 1998. Para 7 b of this communcation provides: -

"In respect of all the collections from the retail customers in cash/stamps/ franks, the collection agent will be paid agency commission of 2%(as given in para 5.3), on daily basis".

(b) The instruction for licensing and use of Franking Machines as ameneded along with summary of changes made was notified vide PO Division communication No. 41-13/ 95- PO dated 08.04.1996.

(i) Para 5 under "Instructions for use of Franking Machine of this communication provides: -

"the franked articles shall normally be accepted in one post office of the status of LSG or above as specified by the licensee which will be the designated office. However, in the case of genuine difficulty to the individual licensee, he may be allowed to post his mails in a second office, which should be a sorting office or mail office. Commercial licensees will be allowed to post their articles in on Post Office, Mail Office or Bulk Mail Centre only".

(ii) Para 6(b) of this communication provides: -

"A commercial licensee can frank the mails of his client(s). In such a case, the licensee should send such franked articles to the Post Office/ RMS office with a certificate with each consignment mentioning the name of the client, number of articles, value franked and total value and certifying that they are bonafide transactions carried on by the licensee on the behalf of the client(s).

3. In view of above, the issue raised in Para 1 above is clarified as under: -

(a) Licensee of franking machine, either individual or commercial (as defined in PO Division communication referred to in para 2) is not allowed to route their franked articles through Speed Post Outsourcing Agents to their designated office of posting.

(b) Speed Post Outsourcing Agent is not allowed to bring frank mail generated by Franking Machine of an individual or commercial licensee to Post office and claim commission under Speed Post Outsourcing Agent Scheme.

(c) In an individual or commercial Franking Machine License holder is also a Speed Post Outsourcing Agent, he/ she cannot act as a Speed Post Outsourcing Agent in respect of mail generated from his/ her franking machine.

(d) The word 'frank' mentioned in BD Directorate letter No. 2/ 17/ 96/ BD dated November 23, 1998 refers to a manner of prepayment of postage. 'Frank' in this context implies those frank impressions that are obtained from a Post office as proof of prepayment of postage due in lieu of postage stamps.

Compassionate Employment: HC relief for destitute


The Madurai bench of the Madras high court has come to the rescue of a destitute girl who has sought employment on compassionate grounds with the state transport corporation.

One S Mareeswari's father was working as conductor in the Tamil Nadu State Transport Corporation, Virudhunagar region, and after serving as permanent conductor for about 20 years, he died on 1995 due to an illness, leaving behind her, her mother and sister with 80% disability. Unfortunately, her mother also passed away the next year.

When her father died, Mareeswari was aged seven and studying in school. Under these circumstances, she and her sister were left in the lurch.

On seeing their plight, a friend of their family voluntarily came forward to take care of them.


As she was a minor then, she applied for compassionate appointment only in 2008. The transport corporation insisted that she produce proof such as community certificate and ration card in support of her candidature. But in view of the fact that the petitioner was not able to obtain ration card, community certificate and residential proof, she submitted affidavits issued by a notary public. However, she was not given compassionate appointment on the ground that she had failed to produce relevant documents. Hence, she petitioned the court.

In view of these difficulties faced by Mareeswari, her counsel R Ramasamy prayed to the court to issue a direction to the transport corporation to provide compassionate appointment to his client without insisting upon submission of ration card, community certificate or employment and property certificates.

He further said this was a special case where the petitioner, after the death of her parents, was being taken care of by a well-wisher as there was no other family friend to help her.

Allowing her petition, Justice T Raja directed the transport corporation to consider her case sympathetically without insisting upon other documents. Pointing out that since the legal heir certificate issued by the tahsildar in1997 certified that Mareeswari was the daughter of deceased Sundaram, and with her sister also giving a certificate relinquishing her right to claim compassionate appointment, the judge said, "There may not be any impediment for the transport corporation in considering her case."

Justice Raja further directed the transport corporation to provide compassionate appointment on the basis of the documents submitted by the petitioner earlier, within a period of eight weeks with an undertaking from the petitioner to produce all relevant documents within one year from the date of joining duty.

EPF Contribution


The following steps have been taken by the Employees’ Provident FundOrganisation to recover the outstanding amount:
1. Attachment and sale of movable and immovable properties of the defaulting establishments.
2. Appointment of receiver to run the business of the defaulting establishments.
3. Arrest and detention of defaulter.
4. Prosecution of defaulters before courts of law.
5. Levying damages as penalty.
6. Directing persons from whom any amount is due to the defaulter to pay the same amount against Provident Fund arrear instead of paying to the defaulter.
The details are given at Annexure.

There is no provision of confiscating the property of defaulters under the Employees’ Provident Funds & Miscellaneous Provisions Act, 1952. However, 84 arrests were made and 2,842 convictions were ordered by various courts during the last three years.
This information was given by the Minister of Labour and Employment Shri Mallikarjun Kharge in reply in reply to a written question in the Lok Sabha today.

Central Government Employees to travel by air to North Eastern Region on LTC

Special Package for North-Eastern Region

The Ministry of Tourism, as a part of its promotional activities releases print, electronic, online and outdoor media campaigns to promote various tourism destinations and products of the country including the North East Region. Besides, North East specific media campaigns are launched to promote the entire North East Region. The Ministry of Tourism provides complimentary space to the North Eastern States in India pavilions set up at major international travel fairs & exhibitions. Further, In relaxation of CCS (LTC) Rules 1988, the Government has decided to permit Government servants to travel by air to North Eastern Region on LTC as follows:-

(i) Group A and Group B Central Government employees will be entitled to travel by Air from their place of posting or nearest airport to a city in the NER or nearest airport.

(ii) Other categories of employees will be entitled to travel by air to a city in the NER from Guwahati or Kolkata.

(iii) All Central Government employees will be allowed conversion of one block of Home Town LTC into LTC for destinations in NER.

(c): Every year 10% of the total plan allocation of the Ministry of Tourism is mandatorily earmarked for releasing funds to the States of the North East Region. This apart, following special dispensations are given to the North Eastern States:

(i) Under the scheme of product/infrastructure development of destinations/circuit, budget accommodation, restaurants, etc. are allowed to the States of North East Region, selected places of J&K and Eco Tourism projects only.

(ii) For organizing fairs & festivals 100% central financial assistance is allowed to the North Eastern States & the State of Jammu & Kashmir only.

Central Government employees’ Retirement age


Raising the Retirement age of Central Government employees
Union Minister of Labour and Employment Shri.Mallikarjun Kharge has given the answers to key questions raised by Shri.P.Viswanathan in the Lok Sabha regarding the raising of retirement age for Central Government employees.
Questions :
(a) Whether the Government proposes to raise retirement age and retirement pension in private sector in the country;
(b) if so, the details thereof;
(c) whether the Government has issued any directions to implement the above recommendations;
(d) if so, the details thereof ; and
(e) the time by which the above proposals are likely to be implemented?
Answers :
(a) & (b): There is no such proposal at present.
(c) to (e): Do not arise in view of the reply given above.

Improved standard of living has come with a big “side effect”. The accessibility and availability of vehicles, television, and desk work have taken their toll! A sedentary lifestyle is now considered so bad for you that The American Heart Association lists it as a major ‘risk factor’ on a par with high blood cholesterol, high blood pressure and cigarette smoking for your heart. In addition to improving cardiovascular health, walking helps with back pain, arthritis, osteoporosis, varicose veins, reducing cholesterol, and other medical problems where inactivity is a factor. Walking also improves the mood and helps bowel movement and sleep.

Walking is one of the easiest and most profitable forms of exercise. All you need is a good pair of shoes, comfortable clothing, and desire.

HOW TO START


It is easy! Just walk out the door. For most people this means head out the door, walk for 10 minutes, and walk back. Do this every day for a week. If this was easy for you, add five minutes to your walks next week (total walking time 25 minutes). Keep adding 5 minutes until you are walking as long as desired.

WATCH your posture. Walk tall. Hold your head up and eyes forward. Your shoulders should be down, back and relaxed. Walk with a natural stride.

Be sure to drink plenty of water before, during, and after walking. Start your walk at a slow warm up pace, stop and do a few warm up stretches. Then walk for the desired length of time. End your walk with the slower cool down pace and stretch well. Stretching will make you feel great and assist in injury prevention.

HOW MUCH TO WALK?

If you are walking for the general health benefits try to walk 30 minutes a day, most days of the week, at a "talking" pace. (Talking pace means you have elevated breathing, but you can still carry a conversation.)

To improve cardiovascular fitness you should walk 3 to 4 days a week, 20 to 30 minutes at a very fast pace. At this pace you are breathing hard but not gasping for air. If you are walking for weight loss you should walk a minimum of five days a week, 45 to 60 minutes at a brisk pace.

WHAT WALKING GEARS DO YOU NEED?
One of the easiest fitness activities is walking and a big reason it is so easy … you don’t really need any gear. Below are a few items to consider. Shoes – The most important item you need is a good pair of walking shoes. Shoes should fit comfortably, have a flexible sole and plenty of toe room.
Socks – As important as what shoes to wear is your choice of socks. Be sure to wear the socks you will walk in when trying on shoes. Cotton socks are preferable to synthetic ones.

Clothing – Wear what is comfortable for you. On cold weather days, layer your clothing so items can be removed as you warm up.

Water – Please be sure to drink plenty of water. If walking around the block drink some water before you head out and more when you return. If walking for longer than 30 minutes take your water along. Be sure to drink every 20 minutes. There are many convenient water carriers – from waist packs to shoulder carriers. Choose what works best for you.

Pedometer – A pedometer is a device that counts your steps and/or mileage. They must be accurately adjusted to your stride length to get a good reading. They come with a variety of features. Some will even calculate calorie expenditure. The most sophisticated versions are the new GPS systems. These actually calculate speed and distance based on satellite readings!

Personal Stereo – A personal stereo / CD player can be a great walking companion. Music can motivate you and energize your workout while helping to pass the time by
creating a distraction. Be sure to keep the volume at a low enough level so you can hear what is going on around you.

A Training Diary – A diary or fitness log is a great tool. Use it to write down your goals, and keep track of your fitness program.

TREADMILL WALKING

Treadmill is an optional device for walking. Owning a treadmill makes sticking with your walking routine easier. If time, personal safety, allergies, or weather conditions, limit your outdoor walking a treadmill can be a great asset.

Now-a-days more and more people are investing in a treadmill. They come in different varieties. Before buying one, take your time and compare different models. But most
important aspect is using it! An unused treadmill is a waste of money.

Two-Day Philatelic Exhibition“Aravali-A Series of Stamps” Begins at Rail Museum

A two-day District Level Philatelic Exhibition“Aravali-A Series of Stamps” organized by the Delhi Postal Circle, Department of Posts (DoP) was inaugurated here today by Lt General V K Pillai, SM, General Officer Commanding, HQs, Delhi Area in the presence Ms Rameshwari Handa, Chief Postmaster General, Delhi Circle. A special cover on Barsilight Railways was also released on this occasion. A set of “My Stamp” was also presented to Shri Manu Goel, Executive Director(Heritage) Railway Board.

In his inaugural address Lt General V K Pillai said that Department of Post has special place in the lives of men in uniform as letters carry emotions to and fro from their homes. He disclosed that that he himself has a good collection of stamps.

Speaking on the occassion Shri Manu Goel shared long association of Deprtment of Posts and Railways. He informed that names of the trains with suffix Mail, like Punjab Mail used to imply that mail was transported by that train.

Ms Rameshwari Handa, Chief Postmaster General, Delhi Circle said that Communication and movement is common to the three institutions of DoP, Railways and Army. She said it is an excellent opportunity for all to share and learn from each other.

India Post carries out various activities to create awareness about importance of Philately by organizing road shows, exhibition, quiz competition, Philatelic Workshops, Stamp Designing Contest etc, at different places in order to facilitate school children to attend easily. This year, Delhi Postal Circle is organizing a series of philately exhibitions. This i Philatelic Exhibition in South West Division during 24th and 25th November 2011 at National Rail Museum is third such exhibition, which would certainly be a place of interest for the children. Children from around 50 schools will participate in this event. The exhibition has been named as “Aravali - A Series of Stamps”. Students of age group up to 18 years will participate in the exhibition and display their exhibits. The exhibition will be informative and of educational experience for all the children. Different activities like Design a cover (Painting competition) on the theme of 100 years of Delhi and quiz competition will be held during the exhibition.

The closing ceremony will be held tomorrow at 11.30 a.m, in which the winners of the painting competition and quiz etc will be awarded.

In the revised PA/SA recruitment rules, the confirmation examination has been removed. There is no confirmation examination hereafter. All will be confirmed by DPC committee as per 6 (i) (12) of the said rules.

  • As announced by Hon'ble Minister of Railways while presenting Railway Budget 2009-10 in the parliament on 03-07-2009, it has been decided to reduce Tatkal Charges as given below.
  • The Tatkal Charges have been fixed as a percentage of fare at the rate of 10% of basic fare for second class and 30% of basic fare for all other classes subject to minimum and maximum as given in the table below.

  • The above charges will be levied uniformly both in peak period & non-peak periods.
  • Tatkal tickets will be issued for actual distance of travel, instead of end-to-end, subject to the distance restriction applicable to the train. The same Tatkal berth/seat may be booked in multiple legs till preparation of charts. At the time of preparation of charts, unutilized portion may be released to the General RAC/Waiting list passengers.
  • Tatkal facility will be introduced in Executive Class of Shatabadi Express trains also, by earmarking 10% of the accommodation available i.e. 5 seats per coach.
  • Tatkal booking opens at 8 AM on One days in advance actual date of journey excluding date of journey w.e.f. of 21.11.2011(commercial circular no:59 of 2011). e.g. for train leaving on 6th, Tatkal Booking will Commence at 8 AM on 5th.
  • No duplicate Tatkal tickets shall be issued. Duplicate Tatkal tickets shall be issued only in exceptional cases on payment of full fare including Tatkal
    charges.
  • Tatkal tickets shall be issued only on production of one of the eight prescribed proofs of identity (as mentioned in Commercial Circular No.5 of 2011 issued vide letter No.2010/TG.I/20/P/Tatkal dated 28.01.2011) as per procedure explained below:-
a. For this purpose, a self attested photo copy of the proof of identity of anyone passenger shall be attached to the requisition slip.
b. The details of the identity proof shall be captured by the system and indicated on the reserved tickets as well on the reservation chart.
c. It will not be mandatory for the passenger(s) to go to the counter to book the Tatkal ticket, however, the proof will have to be sent in the
aforementioned manner.
d. During the journey, the passenger, whose identity card number has been indicated on the ticket, will have to produce original proof of identity indicated on the ticket, failing which all the passengers booked on the ticket shall be treated as traveling without ticket and charged accordingly. Indication will come on the ticket regarding carrying the same original proof of identity during the journey, as indicated on the ticket.
e. If the passenger whose identity card number is indicated on the ticket is not traveling, all other passengers booked on that ticket, if found
traveling in train, will be treated as traveling without ticket and charged accordingly.
  • Agents / RTSAs shall be restricted from the booking Tatkal tickets at thecounters between 0800 hours and 1000 hours. This restriction shall be
    enforced through frequent inspection at the counters. The agents both web service agents and web agents shall also be restricted from booking Tatkal tickets on the internet between 0800 hours and 1000 hours.
  • Even for internet booking for Tatkal tickets, the passenger shall enter the identity proof type and number, which is to be used for travel. These details shall be printed on the ERS/indicated on the MRMNRM as well as in the reservation chart.
  • It will be possible to book a maximum of only four passengers per PNR forTatkal tickets.
  • The web services agents of IRCTC will be permitted to book only one Tatkal ticket per train per day on the internet.
  • The facility of change of name is not permitted on the bookings made under Tatkal scheme
  • For the purpose of granting refunds & issuing TDRs for W/L, the time limit will be the same as applicable for refund of normal tickets.
  • REFUNDS - No refund will be granted on cancellation of confirmed Tatkal tickets/duplicate tatkal ticket except in case of circumstances mentioned in para 2 of instructions contained in Commercial Circular no. 53 of 2006 issued vide letter no. 2006/TGII/ 20/P/Tatkal, dated 30.06.2006. However, full refund of fare and tatkal charges will be granted on the tickets booked under Tatkal scheme in the following circumstances :-
    • If the train is delayed by more than 3 hours at the journey originating point of the passenger & not the boarding point if the passenger's journey originating point and boarding point are different.
    • If the train is to run on a diverted route and passenger is not willing to travel.
    • If the train is to run on diverted route and boarding station or the destination or both the stations are not on the diverted route.
    • In case of non attachment of coach in which Tatkal accommodation has been earmarked and the passenger has not been provided accommodation in the same class.
    • If the party has been accommodated in lower class and does not want to travel. In case the party travels in lower class, the passenger will be given refund of difference of fare and also the difference of Tatkal charges, if any.

Know About General Provident Fund (GPF)

The GPF Subscription of an employee of the Central Government is governed by General Provident Fund (Central Services) Rules 1960



1.What constitutes ‘Family’ for the purpose of GPF Rules?

a.In the case of a male subscriber, the wife or wives, children, the widow or widows and children of a deceased son of a subscriber.
b.In the case of a female subscriber, the husband, children, the widow or widows of deceased son of a subscriber.
A female subscriber can exclude her husband from the list of Family Members

2.Is an adopted child a member of the family?


Yes, if under the personal law of the subscriber, the adoption is legally recognized.

3.Who is eligible to join the Fund?

a.Subscription to the Fund is compulsory for all Government servants who joined before 1-1-2004.

4.What is the minimum amount of subscription?


6 % of pay for the month of March of the preceding year.

5.What is the maximum limit of subscription?

Not more than the emolument (for the month of March of the preceding year).

6.Can the subscriber alter the rate of subscription?

Yes. The rate can be increased twice and / or decreased once at any time during the course of the year and the amount of subscription so fixed shall remain unchanged during the year provided that the revised subscription conforms to the minimum and maximum limits.

7. How many GPF Accounts can a subscriber have?

Unlike insurance policies, a government servant can have only one G.P.Fund Account.

8. How is subscription to GP Fund recovered?

a. When emoluments are drawn from a government exchequer, recovery of subscriptions and advances shall be made from the emoluments themselves.
b. In the case of a subscriber on deputation to a body corporate owned or controlled by Government, the subscription shall be recovered and forwarded to the Pay and Accounts Officer by such body.

9.When can a subscriber stop subscription to the Fund?

Subscriptions to the Fund shall be stopped 3 months prior to the date of retirement of the subscriber. Subscription shall be stopped during suspension, and at his option during half pay leave / leave without pay and dies-non.

10.Why should a subscriber make a nomination?

By making a nomination, the subscriber can confer on one or more persons of his / her family, the right to receive the amount that may stand to his credit in the Fund in the event of his/her death before the that amount has become payable or having become payable has not been paid. The subscriber can cancel a nomination any time by sending a notice in writing to the D.D.O.

11.Can a subscriber nominate more than one person?

Yes, but the subscriber should specify the share payable to each nominee in such a manner as to cover the whole of the amount that may stand to his credit in the Fund.

12.When does GPF amount become finally payable?

The GPF amount to the credit of a subscriber becomes finally payable on quitting Government Service.

13.Can any amount other than subscriptions and refund be credited to the GPF?

Unless specifically provided for by the Government no amounts like Leave Salary Encashment, Pay Arrears etc., can be credited to the GPF.

14.How GPF Balances authorised when subscriber reported as missing?

After Lapse of one year from the date of FIR filed with police, GPF Balance shall be eligible to the nominees as filed by the subscriber.

15.Can a Subscriber nominate any person other than a family member?

At the time of making the nomination, if the subscriber has a family, the nominationcannot be made in favour of any person other than a family member.

16. What are the purposes for which advance from GPF can be sanctioned ?

Medical treatment of the subscriber or his dependent.
Higher education of subscriber or dependant in specified academic*, medical, engineering, technical or scientific process.
Marriages, funerals or other ceremonies.
Legal action faced by the subscriber or dependants except where the subscriber has initiated legal proceedings against Government challenging conditions of service, penalty etc.
Legal fee for defending himself against official enquiry for alleged official misconduct.
Purchase of consumer durable like TV, VCR, Computer, etc.

17. Who can sanction an advance?

The Head of Office may sanction the payment to any subscriber of an advance consisting of a sum of whole rupees and not exceeding in amount three months’ pay or half the amount standing to his credit in the Fund, whichever is less.
In special circumstances, advance above 50% of balance may be sanctioned, considering the status of the subscriber and the purpose mentioned at 16 for which the advance is sanctioned by the Head of the Department.The Head of the Department may also sanction the another advance before repayment of the last installment of any previous advance.

18. Can advance be sanctioned to a subscriber who is under suspension?

Yes, if he agrees in writing that recovery can be effected from his subsistence allowance.

19. When and how can a Part Final Withdrawal be allowed?

Part Final Withdrawal may be sanctioned by the authorities competent to sanction advance for special reasons, at any time after the subscriber completes 15 years of service or within 10 years before retirement, whichever is earlier and

20. What are purposes for which Part Final Withdrawal is allowed?

Part Final Withdrawal is admissible to meet the expenditure in connection with :
Medical treatment of the subscriber or his dependent ;
Higher education in specified academic*, medical, engineering, technical or scientific courses of the subscriber or his dependent
Betrothal or marriage of children or any other dependent female relative;
Acquisition or construction of residential house (including cost of site), repayment of loan taken for the purpose and reconstruction or making additions or alteration to a house already owned or acquired;
Payment of an installment (other than monthly installment) to a Housing Board/Society towards cost of a house/flat subject to the limit specified in Rule and production of approved plan;
Acquisition of farm land and/or business premises before six months from the date of retirement;
Purchase of consumer durable such as TV, VCR, Computer etc.
Purchase of a motor car or repayment of loan taken for that purpose.

21. How many withdrawals are allowed for the same purpose?

Only one. Marriage, education or illness of different children will not be treated as same purpose. Betrothal and marriage of the same child/female dependent are treated as different purposes. PFW for higher education, subject to monetary limits specified, may be permitted every year for the same purpose.

Subject:- Awareness generation through Brochure on Pensioners Portal – Mission Mode Portal under NeGP.
Ministry of Personnel, P.G. and Pensions Department of Pension and Pensioners’ Welfare, New Delhi have implemented a web based Mission Mode Portal on pensions namely Pensioners Portal under the Notional e- Governance Plan of Government of India. The primary aim of the Portal is to make the pension / retirement related information, services and grievance handling mechanism online for the needy pensioners though a combination of interactive components which will help to bridge the gap between the stake holders and the Government. It also aims to keep the pensioners aware of their rights and responsibilities / obligations.

2. With a view to achieve the objectives of the Pensioners Portal Department of Pension and Pensioners’ Welfare have issued a broacher to create awareness amongst the retire and retiring civil pension. The same have been uploaded on CGDA’s website www, cgda.nic.in > at Home/Pensioner Corner/Broacher on Pensioners Portal location. The brochure on Pensioners Portal may be downloaded and printed for distribution amongst the DAD employees who would be retiring from your office / organisation in near future.

Points to remember for Cheque Deposits:
  • Investment in KVP through Cheque should not be accepted w.e.f. 28.11.2011. If any cheque presented before 28.11.2011 is cleared after 30.11.2011, the amount should be refunded to depositor.
  • After 25.11.2011 while accepting cheques for opening MIS, rubber stamp should be affixed on counterfoil “No Bonus shall be payable if cheque is credited to Govt. Account after 30.11.2011
  • Rate of interests applicable according to the Date of Clearance of cheque.
